De weg naar Thai national

Mario08, ik woon in Thailand op basis van retirement, ben 54 jaar oud en ik ontvang voldoende inkomen vanuit NL.
Op die basis heb ik dus geen workpermit en ook geen werk visum.

Dat is waarom ik je aanraad eerst te praten met immigratie in Bangkok voordat je een aanvraag indient. Zij kunnen je kansen het best inschatten en vertellen of het zin heeft of niet om op basis van je huwelijk een aanvraag in te dienen.

Als het even kan dan vermijd ik het om voor Jan met de korte achternaam naar Bangkok te reizen.
Vandaar dat ik me probeer te informeren zoveel het kan, desnoods betaal ik een advocaat om me te informeren.
Zoals de resultaten nu zijn lijkt het dat ik weinig kans van slagen heb.
Ik wacht dus liever even verdere informatie af alvorens naar Bangkok te vliegen.

Ik ben me momenteel ook aan het verdiepen in de mogelijkheden van citizenship, en daarbij de stap van permanent residency over te slaan. Dit is enkel mogelijk indien je voldoet aan verschillende voorwaarden. De belangrijkste zijn dat je 1) gehuwd bent met een Thaise, 2) belastingplichtig bent in Thailand, 3) minimaal drie (of vijf) extentions of stay hebt van een jaar. Je dient daarbij ook minimaal 3 jaar gehuwd te zijn (of 1 jaar indien je samen een kind hebt).

De voorwaarde dat je belastingplichtig bent in Thailand is echter cruciaal. Voldoe je hier niet aan dan ben je aangewezen om eerst PR aan te vragen en dan na een jaar of vijf alsnog citizenship. Je moet dan ook het koningslied en volkslied kunnen zingen

Ben ook in Bangkok langs de Special Branch geweest van het police headquarter in Bangkok. Moet eerlijk zeggen dat ik daar niet veel wijzer van ben geworden. Erg behulpzaam zijn ze niet. Uiteindelijk wel in staat geweest om aan de hand van onderstaande lijst te concluderen dat ik (zou moeten...) voldoen aan de criteria. Op de vraag hoe lang zoiets gaat duren werd me verteld dat het vooral afhangt van de tip .

Hieronder de (volledige) lijst met voorwaarden. NB: Lees deze voorwaarden als zijnde dat je al in bezit bent van Permanent Residency. Indien dat niet zo is dan zijn de zogenoemde 'personal ties' van belang.

In respect of the processing for consideration of applications for Thai citizenship by naturalization His Excellency the Minister of the Interior on this 14th day of October 2009 gives approval for the setting of qualifications of applicants for naturalization as follows.

1. They should have reached the age of majority according to the laws of Thailand and the laws of the country of their own nationality.

2. They should have a record of good conduct. They must be found to have no criminal record in Thailand after due investigation (finger prints must be taken and checked against records). Their record of political activities must also be investigated and nothing incompatible with good conduct found. They must have no record of involvement with illegal drugs or of any activities deemed harmful to national security. Investigations must also be made to check for any criminal records overseas.

3. They should be able to show evidence of pursuing a profession in Thailand in the form of an affidavit from the Department for Foreigner Workers or from a provincial branch of the Department of Employment. They should have an income not less than the amount specified as follows.

3.1 Applicants with no direct personal ties with Thailand should have an income of not less than 80,000 baht a month supported by a letter of confirmation of monthly salary/income and must show evidence that they have paid tax for not less than 3 years; or they should they should have paid personal income tax of more than 100,000 baht per year for the 3 tax years prior to their application for naturalization

3.2 Applicants with direct personal ties with Thailand, such as those married to a Thai citizen, those with children who are Thai citizens, or those who graduated from an institute of tertiary education in Thailand should have an income of not less than 40,000 baht a month supported by a letter of confirmation of monthly salary/income and must show evidence that they have paid tax for not less than 3 years; or they should have paid personal income tax of more than 50,000 baht per year for the 3 tax years prior to their application for naturalization.

4. They should have received permission from the Immigration Bureau to remain permanently in the Kingdom of Thailand and be able to show supporting documentation in the form of a Certificate of Residence, an Alien Registration Book, or a House Registration Certificate (Thor Ror 14) that proves incontrovertibly that they have been permanently resident in Thailand for not less than 5 years.

5. They should have been permanently resident in the Kingdom of Thailand for not less than 5 years counted from the date they received their Certificate of Residence, Alien Registration Book or House Registration Certificate (Thor Ror 14) that proves incontrovertibly that they have been permanently resident in Thailand for not less than 5 years.

6. They must have knowledge of the Thai language according to the ministerial regulations. They should be able to speak and understand Thai, sing the national and Royal anthems and must pass an interview in Thai.

6.1 Applicants who reside in Bangkok must pass an interview with the Sub-Committee for Screening Applications for Thai Citizenship through Naturalization.

6.2 Applicants who reside in the provinces must pass an interview with their Provincial Labour Committee, according to the regulation of the Sub-Committee for Screening Applications for Thai Citizenship through Naturalization, Applications for Thai Citizenship based on Marriage to Male Thai Citizen and Applications to Recover Thai Citizenship by Former Thai Citizens dated………………..

7. Applicants should produce a document that they have submitted to their embassy or consulate in Thailand that demonstrates their intention to renounce their existing citizenship when they are approved for Thai citizenship.

8. Applicants must obtain not less than 50 points in the qualifications test listed in Appendix A for their applications to be forwarded for consideration.

Voor allebei schijnt een Werkvergunning en belasting historie noodzakelijk te zijn.

Dus terug naar jaarlijkse visum verlengingen op pensioen basis........

Voor residentie is ook een criteria dat je een inkomen hebt in Thailand, en ik dacht iets van minimaal 80,000 thb en derhalve belasting betaalt

als je een investment visum hebt dan betaal je wel belasting maar hebt geen werkvergunning
zelfde geldt voor inkomsten uit belegging
zelfde geldt voor inkomsten van uitkering die je hier als inkomsten aangeeft en belasting over kan of wil betalen

application submission year and a copy of the filed personal income tax returns e.g. P.N.D.50 which must be officially certified by
the revenue officers
8. Copy of the applicant’s monthly income tax form (por ngor dor 1) with receipts from the beginning of the year of application
submission (January) until the previous month of application submission which must be officially certified by the revenue officers
9. Certificate of the juristic person registration of which the applicant is working with, that must be issued and officially certified by
the Ministry of Commerce within the previous 3 months prior to the application submission date
